Everyone encounters a bad day. Even seasoned expert witnesses occasionally encounter situations that spell potential disaster in performing their expert analysis, in preparing for trial or on the witness stand. In this session we will explore procedural, evidentiary and human variables that prove problematic for many experts. We will explore the strategic approaches and tactics employed by the most effective experts when all appears to be going wrong.
Learning Objectives
After completing this webinar participants will be able to:
· Identify warnings that signal problematic counsel, clients and case fact patterns
· Illustrate the impact of unreasonable assumptions and tainted evidence upon expert opinions
· Formulate appropriate responses to case developments that jeopardize the expert's credibility
· Recognize the dangers that accompany shape-shifting cases
· Plan and formulate ways to invoke the human factor in situations of adversity
· Employ the "hypothetical question" approach to avoid impeachment
